Donnelly, Conroy & Gelhaar, LLP partner Timothy H. Madden has been named a 2024 Lawyer of the Year by Massachusetts Lawyers Weekly for securing a reversal in the First Circuit on behalf of client Granite Telecommunications, LLP. The case presented the question of whether an insurer is entitled to be reimbursed for amounts paid to defend and settle an underlying personal injury claim, where the insurance policy did not include a right to reimbursement. The First Circuit’s decision in Berkley National Insurance Company v. Granite Telecommunications, LLC clarified that absent agreement by the insured – either in the policy or otherwise – an insurer is not entitled to reimbursement of a settlement it voluntarily paid, regardless of whether the underlying claim is covered by the policy, and that an insurer is not entitled to recoup defense costs absent the effective reservation of such a right.
